Hi XXXX XXX XXXXX. Thank you for asking your question on Just Answer.
As this is private land, you have a right to quiet enjoyment of the property. The uninvited persons being on your property are denying your this quiet enjoyment.
To eliminate this problem you should mark, either by a fence or shrubbery, the boundry lines as they border a public area or another's property. Also, you should conspicuously post no tresspassing signs.
Here is a supreme court precedent:http://www.law.cornell.edu/supct/html/historics/USSC_CR_0326_0501_ZD.html
About the 5/6th paragraph is a specific law pertaining to private premises, which is Title 14, § 426, Alabama Code 1940
The police, at your request, are to remove the persons who trespass on your property at your request. This is served as a warning, upon further trespass, they can be arrested at your request....you would be required to file a civil complaint on this state code.
In short, the police were wrong and you should notify the chief of police or the sheriff in writing of the police's refusal to remove trespassers from your property.
Thank you again for trusting us with your problem. Please reply as soon as possible so that we can finish answering your question.
