Question

I am a business owner looking to relocate to the adjacent town. The prospective property is correctly zoned, and similar practices regulated by the same State Board already exist within Town limits, yet I am being asked to apply for a "Use Permit". This process will take longer than the property owner is able to wait for the lease signing, so my business will miss the opportunity. Is this "Use Permit" process even necessary?

I have followed Town Hall's requests, furnishing documentation, personal discussion with Planning and Zoning Assistant, and prepared the large amount of proposal documents for a deadline I was given 36 hours notice to meet.

Hi! One of the reasons a "use permit" is required is so that the operating business is very clear on the parameters and met all the requirements for the use of the land, dwelling or area without causing damage or altering it's natural state. It simply says what you can and can not do so that any adjacent property is not affected as well. PART of the reason this came into being was traveling carnivals. Sometimes the damage to the property outweigh the value of the fun. This is what you do. The Zoning/Planning board can accept your proposal and waive the waiting period.

Put together your plan from soup to nuts. Be very clear that you will follow all the rules and regulations and due diligence at every moment. Explain how you have anticipated any issues that could effect this and already have a plan to avoid this. Since I don't know the business, this is a crap shot for me as well in trying to cover all the bases to help you. THEN point out to the committee how this will benefit the community and the people. And also become something that they will enjoy, like, have fun, etc. AND that this business does NOT compete, but complete..get it? This is the angle you work to encourage them to let you operate your business. ALSO explain that you have a time constrain and that you must have the permit for your business to be a suvccess to the community! The bottom line is you do NO damage, everyone benefits and there is a huge return for everyone. Be professional and show enthusiasm and you should be okay.
