Question

If a couple is divorced and the husband is court ordered to be able to claim the child every other year on his taxes and the ex decides to claim that child on the years that ARE his to claim such child who is the one that is in the wrong ?

Under section 152(e) of the IRC the custodial parent will be the one who is entitled to claim the dependency exemption unless there has been an agreement otherwise. It seems to me that if the court has structured the agreement otherwise, then the custodial parent is required to follow that and permit the non-custodial parent to claim the dependency exemption.

 The correct claiming of the child will be determined by the court document. 

If the custodial parent claims the child in error, the noncustodial parent should file their return correctly even if they know the child has already been claimed.  Attach a copy of the court decree to the return to avoid delay in receiving a refund.

I always recommend that court documents indicate which year each parent will be eligible for the child's exemption.  Example:  mother claims even years/ father claims odd years, etc
