Question

I have a 21 year old son whom has been working for the past 6 months. I know I cannot claim him but do I have to claim his income as mine? He has no expenses whatsoever. He is still at home. I would appreciate any help you can give me.

Is your son a full time student?

If he isnt a full time student then you cannot claim him but you certainly dont include his income on your return. He should file his own return and pay his own tax.

Answer

If your son is a full-time student, you can claim him on your taxes, no matter how much her earns from his job.

If he is NOT a full-time student, you can claim him if he makes less than $3,100 in 2004.

His income is never included on your return - he must file his own return, if a return is needed - even if just to claim a refund of withholding.
