The Americans with Disabilities Act states that public places must make reasonable efforts so that the facility is accessible.

http://www.usdoj.gov/crt/ada/ Will have more information. I believe that you can contact your local building inspector and let them know that the location is accessible and does not conform with the Americans with Disabilities Act.

Also, you can contact the federal ADA @ http://www.usdoj.gov/crt/drssec.htm There are several phone numbers. This is likely an oversight, but between the building code inspector and the ADA, you should be able to get the owner to change the building to be accessible.
