Are family members responsible for mother’s credit card debt when she dies. My Mother did not have property in her name and does have some insurance policies for funeral expenses. She also has a balance in her checking account.

 No. Do not pay bills or taxes owed by an estate with your own money. Anything you pay can cause the net value of the estate to rise, possibly increasing taxes owed by the estate. As the executor of the will you are not legally responsible for the debts of the estate. Private debts not covered by the estate are usually written off by collectors or can be settled for small percentages of the original debt.

Can't we just send a copy of her death certificate to the credit card company and explain that their are not enough assets to go through through the courts.
