Question

My daughter was driving her friends car. They got in a wreck. The friend told the police that she was driving the car so she wouldn't get in trouble with her mom. It all came out months later and the mom is trying to sue me for the damages. The car is totalled. What am I legally responsible for?

Already Tried:
Went to her house 9 months ago and offered to work with her and figure out what to do. She said that the car was not worth fixing and there was nothing that I could do. 9 months later she is sending me estimates and threatening to sue me.

you are liable for your minor children and that includes civil actions against them. now, because the other girl allowed your daughter to drive, you could negoiate with the parent for a settlement - noting that her daughter was just as much at fault - 50/50. if you come to an agreement on the cost, then you will need to make sure your daughter works to pay you back or if monthly payments that she is making them.

Am I responsible for paying for the car to get fixed or the value of the car since it was totalled?

thank you for that follow up. what i said was, you are responsible for your daughter's actions while she is a minor. however, because her friend allowed her to drive - the cost should be split 50/50 - each is responsible for your daughter being behind the wheel. therefore, to answer your question - no. not entirely - but a portion.

Sorry I must have worded that question wrong. What I meant was the value to fix the car is six thousand but the car is totalled so the kelly blue book value of the car is four thousand. Would I be responsible for half of the price to fix the car or half of the price of the value of the car?
