Question

I have had pain for 5 years now in my stomach and it gets really bad and I have to go to the hospital. They can't figure out the cause of it and I've been all over the world to different specialist and they can't figure it out. First they thought it was my gall bladder so they took it out. Well that wasn't the problem. But just recently like a week ago they took out my appendix because they said it was abnormal. Well test results came back and there was nothing wrong with my appendix and that surgey was completely a waste. Is there anyway I can sue the hospital because I didn't want to go threw with the appendix but they told me I needed to and I still have the pain I always get.

Answer: One can always sue; the question is, can you win? Medical malpractice cases are extremely hard to win, and very expensive. This makes it hard to find an attorney to take the case. The question will be whether or not the hospital followed medical standards of care and diagnosis, and whether or not they coerced you into the operation.

Don't actually HIRE an attorney without first checking references. And don't try to pick the attorney's brain on the phone. Schedule an appointment and visit the office, like you would for a doctor! You'll want to talk with several before deciding who to hire. Interview the person as you would any other expensive employee. Successful experience? References? Years in practice? Back up attorneys to take over if he or she goes on vacation? Adequate staff to handle a lot of work? Willing to give you a time line and commit to sticking to it (other than by delays caused by the "other side."
