Question

we have transfered an employee over to our company from oct this year. he had an agreement with his old company to take all his holiday in one go over the christmas period(5 weeks). as you may appreciate for the limited time he has worked for this company, his holiday accrual does not cover the 5 weeks he wants to take off. should he have not been paid by his previous employer holiday money up to the time he left their emploment. thanks for your help. keith grosse. manager.

If it was a TUPE transfer as the transferee you are liable for all his holiday accrual.
