Question

My husband forged my name as co-signer on his student loans and also borrowed student loans in my name. I never signed a promissory note. I have only come to find out about these loans because now we are separated and the companies are contacting me. I was enrolled in a 4 year college for 2 years. He did set up the loans that I knew I had which was a federal student loan. The others I had no idea about. What can I do??? He is now addicted to prescription drugs which is the reason for the separation, he has a Master’s degree and isn’t getting a job. Soooooo……. Hmm help please.

I have an appointment with an attorney Tuesday. I also have requested the promissory notes for these loans. I have applied for a payment forbearance on some of the loans that I have found out about to try and buy myself time to figure out what he has done. Now, today I found out that there is more. So far as I am seeing it, there are 3 w/ one company and 7 w/ another. Basicly looks like I paid/borrowed for his masters degree. He says that the loan company has made a mistake and for the 7 loans he is the primary. That is not what they are telling me. That is why I have requested the promissory notes for the loans.

Accepted Answer

You can sue for a declaratory judgment that the signature is not yours and thus you are not liable.
