Question

I received a summons from a supplier that my landscape designer did not pay. My landscape designer has spoken with his attorney and they are hopefully working to negotiate a settlement with the supplier and get my name removed from the lawsuit. My question is do I still need to send back a answer to the summons complaint I received. It stated I need to send one to the suppliers attorney & to the district court. Thank you, Beverly

Absolutely, this needs to be answered and I recommend you hire an attorney to do it for you. If it is not answered, and your name is not removed from the lawsuit by the time it is due, you can have a default judgment entered against you. Also, If you hire an attorney, s/he can work on getting a release for you before this even needs to be answered. A extension to answer can be granted, but the attorney will be able to decide what it best. You can find a local civil law attorney here: www.martindale.com.
