Question

I was caught shoplifting last night. I am a licensed professional, unemployed for almost 10 months. No criminal record. I could possibly lose my license and most probably wouldn't be considered for many government jobs r military positions. I've already been searching for a job with all my heart. I am single and near my last thread, severely depressed with a therapist to confirm it. Would it be possible for aawyer to make a deal that I be put on probation WITHOUT a conviction, so if I stay "clean" for 2-3 or more years, my record could be expunged? Without the initial conviction I could be eligible to keep my license and maybe find a job.

yes. it is very possible for a court to give you a deferred sentence. this means, that if you complete any probation and maintain the conditions without incident, you would be eligible to have the matter expunged. that means, once everything is complete and you would go back into court to have the judge agree you successfully completed probation, you would need to file to have the record removed. it does not just disappear.

 

you can try to strike such a deal with the prosecutor yourself - but it is best for you to contact the public defender's office in your county and seek that assistance. if you are not employed, you should be eligible for those services - unless you have assets that can be convert and then a court may require you hire a private attorney.
