Question

I plead guilty to a dwi first offense. I received a guilty deferred sentence. Completed my probation and other court requirements successfully. I know that the DWI conviction shows up on my DMV driving record. What is the status of my criminal record? I looked up the case on the metro court website and it is listed there. I thought the deferred sentence upon completion would not leave a record in the court system. Bernalillo County, New Mexico was the court.

Good afternoon,

I'm sorry to hear of your dilemma.

A deferred sentence means that after all the court requirements relating to the penalty have been completed, the charge will be dismissed without a conviction being entered. It doesn't mean that all evidence of the arrest and charges are sealed automatically

You may have to now specifically ask the court to seal the record through a petition for an expungement. You can have a local attorney do that for you.
