Question

BOA violation of my privacy/privacy policy act. I have several accounts with Bank of Amer. Florida. I have recently moved to MA (I moved about 3 years ago, but I am still a FL resident--soon to be a MA resident). For whatever reason (unknown to me), my personal account information was disclosed to another, at that time--at the same address living person. I worked for this person and shared a mutual residence. Since several years our accounts were combined for "On Line Banking", which I never requested, signed for or authorized. It could have been done in error or maybe at the other person's request (to have a control over my assets?). This relationship ended few years ago. After moving to MA, I went to my MA, BOA branch, explained the situation, and requested this person's name/account to be removed from my own on-line access. The BOA clerk, explained to me that this person's account couldn't be removed from my on-line access unless I would go back to Florida and resolve this problem at the original, Florida bank. This clerk also stated that this could not be resolved without the other's person presence. I wasn't able to fly to Florida to deal with a problem caused by the bank, so I just lived with this dilemma. Several weeks ago BOA called me and asked me to visit my closest Branch in Holden, MA. Now the "other person" requested to be disconnected from my on-line account access as well. Previously, I wasn't aware of the fact that the other person could see my account on line/have a full access as well. It was never disclosed to me by a bank official until now . No assets were ever withdrawn from my account by the other person.... So, since many years an unauthorized individual (not related) had a full access to my account. -- Originally I thought it was only me who could see his account. What bothers me is that someone else had access to my account for so many years and I wasn't able to "take off this person's name from my accounts" when I wanted to. I feel deceived and it bothers me a great deal that a stranger was permitted to see my account(s). I feel discriminated as well, because I wasn't able to resolve this issue at the local bank, on the other hand, the other person was able to resolve it at his bank in Florida when he wanted to. I will be going to my local BOA within the next few days to resolve this issue. I feel that my right has been violated, am I correct? (I am sorry for the grammar-errors. English is not my native language--I am German/American)

Thank you for the post, but to be clear, how many years did you knowingly have the joint online access?

I didn't known the person could view my account(s) untill about a week or two ago, it was disclosed to me by the bank clerk....however I knew since several years that I could view/see the other person's account. I tried to "resolve" this in FL, before I moved to MA, but the Bank didn't do anything about it.....than, I went to a MA local bank, and the clerk told me he couldn't do anything about it, unless i go back to the FL bank with the other person--he needed his presence.....I wasn't able to do this.....I could not just fly to FL...

thank you for the clarification, online banking in instances such as this is a two way street. It is not the case that you can view another's accounts but they cannot view yours when the accounts are under a single online banking account. Your pricacy rights however were infringed upon when you attempted to cancel the joint online access in Florida and that request was denied.

thanks....would i have a case to go to court with this?

Answer

Yes, to be very honest it probably would not be worth it since you did not sustain any damages as a result of the joint online account access. You could very well end up paying more in legal fees than what you would recover form the bank.

--good enough, I appreciate your answers...I did sustain damages (unprovable)...because the disclosure of my assets, cost me my job and a lot of money, because this relationship was about knowing how much money I had....which is irrelevant now....

Thank you, have a great weekend...
