Have your physicians released you? Are you having any medical problems now? What is the total of your economic losses, medical, wages, etc. . . .? Pete

I have been released by the Orthopedicist. No medical problems now but what about the future. Loss of wages of 3200. in the month that I was out of work and then out of work for 1 month after. Had to take a job with less wages. My hospitalization paid my medical. They replaced my car.

In settling the uninsured claim you would be settling the future claims as well. Do you undertsand that? I would not do that unless you have a clear understanding and commitment from the doc that you are not going to have any problems. This is your one bite of the apple so to speak. Pete

What about pain and suffering. I have a real problem with driving. I only drive when I have to.

Is the lack of driving related to pain or is it related to the fear of driving? Pete

fear

Accepted Answer

The fear is compensable as is pain and suffering. The pain and suffering figure will depend on what your future holds. For example, perhaps 10K is an acceptable figure for the month of pain you have endured. If however, you require surgery in six months or a year down the road, then the pain and suffering you have would, in my view grossly exceed the 10K. I guess my point is that a lot of this depends on what the future holds for you.

As a general rule a reasonable settlement will range from anywhere from three to five times the amount of the special damages. Special damages include the total of the medical expenses (even if you did not pay them but the ins. co did) plus estimated future medical expenses, lost wages and lost future wages and any other out of pocket loss.

I hope this helps. Pete
