Question

My son and his fiance’ are renting a home in Las Vegas – they received a notice on their door that stated, “Attention – entry by unauthorized persons is strictly prohibited to protect the interest of the lender and in accordance with the terms of the security interest the property has been secured to prevent entry by unauthorized persons.” The notice is from Bank of America Home Loans - does not say Foreclosure – but appears that might be what is happening. They are current on their rent – it is due right now – so do they pay? He has contacted their landlord but they have not received a return call back at this time. Will they be notified and will they have time to find another place to rent? Thanks!!

Yes, it sounds like the home is being foreclosed upon.

It would probably be a bad idea for them to quit paying rent now. If the foreclosure is just starting now, it could be several months before the home is sold at auction. If they stop paying now, the landlord could evict them pretty quickly for non-payment of rent.

Regardless, if they are living in the house, they either owe the landlord or the bank for the rent. Ask them if they paid the security deposit and/or last month's rent. If so, it may be a good idea to stop paying the rent 1-2 months before the sale, because it would be nearly impossible to get their money back from the landlord in the middle of a foreclosure.
