Question

I am considered totally disabled by social security and my student loans or in the conditional discharge period which lasts 3 years. my annual social security cheks total 13,920 a year... I have an opportunity to play Santa at Christmas time and will get paid well for it. It is my understanding that the social security checks i recieve are NOT considered earned income and according to the student loan conditional discharge agreement i cannot earn more that 14,750 for a family of two....I dont fully understand if the social security disability checks are counted as earned income or not, If i work as Santa and earn 3 to 4 thousand dollars , will i be jeapordizing my chance at having my student loan discharged ? this is the only work i can do and it is with accomodations and only for one month per year....I sure would appreciate some help on this....

Answer

You would be disqualified if you had annual earnings from employment above the Poverty Guidelines for a family of two in your state.
Social security benefits is not considered as earning from employment. The Department only considers earnings from work performed. However, the Department may require you to provide documentation of the disability/retirement pay to show that the earnings were not from work.

Thank you for your Answer .... I really look forward to playing Santa every Christmas and did it alot more before I became disabled ... But i am still able to do it with the accomodations they give me .....I appreciate your help .....so it is my understanding that they do not consider the social security disability payments as income so i am free to make as much as i can as long as i stay below the poverty line in Texas....You were great ...You are going to make alot of kids happy this Christmas.....
