Question
We own a track of land which we cannot get to from a public highway. we were passing on a private road belonging to the person who owns the property directly below the land we own. The land was leased to another person for farming and that person blocked our access to the road we were using. Our land is 56 acres and is swamp land and is surrended by swamp land except for the land below ours. We use the land for hunting only . We spent a large some of money cutting trees for a shooting clearance. we also built hunting stands and planting grass etc. Is there anything we can do to get to our property?

Accepted Answer
Yes there is something that can be done, but it would require a civil suit requesting an easment across the property to be able to access your landlocked property. If the owner of the landowner is unwilling to assist you by instructing the leaseholder to permit your ingress and egress from the property, you would have to sue the landowner for the easement. The suit would really be an undue expense for both parties since the court would likely summarily grant the easement. My advice is to try to reason with the landowner.

Answer
You would both have to invest the time in attending the court proceedings and filing fees.
