Question

I went to the Peoples Court and the person that was supposed to be the judge didn't seem to know basic things like the statue of limitations of filing a claim. She seemed predisposed and biased and pretty defended the other party without allowing me to present my case. She made statements that were border line racist and prejudiced. Is it possible for me to return to small claims and have the case heard by a real judge? (Not a drama queen).

I filed a claim with Kings County Small Claim. A representative from a court t.v. contacted me. I went before an offense and discriminating lady that seemed more intent on telling me that I had no business trying to purchase numismatic items. I will not accept the $250.00 that they say that they will send and want to continue with my case in small claims.

Consenting to the jurisdiction of the People's court is voluntary. You will need to look at your paperwork to determine whether you agreed that the judge's decision would be binding. If the judge's decision is not binding you can refile the case in small claims court. If the judge's decision is binding you can file an appeal.
