I caught a DUI. I was sleep in the car when officers tap on the window. There was a open bottle of wine in car, in plain sight. The keys where in the ignition. I was not driving, was not seen driving. I was arrested and towed. The registration had expired two days before. Do I have any defence.

Classic question which we see a lot here. You do not have a defense based upon the facts that the car was not started and you were not driving. They can arrest you for being in the drivers seat with the keys and drunk.

Get a lawyer or have the court appoint one. I don't think you are looking at jail time.
