Question

I am a homeowner in Los Angeles Ca. I want to evict my boyfriend. He is an alcholic and is causing me emotional distress. There is no lease nor does he pay monthly rent. He gives me $ sporatically.He is a resident though because he has lived here for years and has my address on all of his bills and license How do I procede and can I use emotional distress as the reason?

No lease is in place and he has been here off an don for 8 yrs so he has established residency

Answer

He is a month to month tenant. You can evict him on 60 day notice and then an eviction action. I would use a local lawyer to handle the process to ensure it is properly handled.

Even if he is causing me emotional distress, putting me in unsafe situation? IE: leaving stove on while I am aslppp, leaving doors open when he passes out, verbally abusing me?

Accepted Answer

You could file a police report and seek a restraining order which would require him in effect to leave because cannot be near you.
