Question

I began receiving SS Benifits in July 09 at age 66. In 04 I was injured on the job and received disability insurance checks till I reached full SS age. My SS payments were calculated thru 04. My question is this; should they have, since I was disabled, given me credit for those 4 1/2 years and calculated my monthly payment based on that. I paid income tax on the disability amount but no social security taxes were deducted. Thank you for your time. XXXXXXX XXXXX

Also, it is important to know that I can only respond to your post and the information contained in it, as I do not know what you know, unless you describe it fully. Also, because you are at this site, you are asking me the question because you want the legal facts, as I see them, even if unfavorable to your situation from a legal perspective. Also, due to site tech reasons, oftentimes I am initially only able to see the first part of your post, so I apologize in advance if I ask a redundant question.

 

That being said, if you would like me to work on an answer for you, and in order to better assist you, could you please clarify for me:

 

1. Could you clarify what type of "credit" you are considering? Are you wondering if the full retirement amount would have been greater than the SS disability amount, because you had 4 more years of income to add to the mix (albeit, SSD income)?

 

2. Also, you indicate you paid taxes on your SSD. Did you have additional income beyond SSD that was taxable income?

I was not receiving SS Disability payments, I was getting disability payments from the Hartford. I had taken this policy out when I was working. If I could have those 4 years added beyond 04 it would increase my regular SS monthly income since it was calculated without that amount in the mix. Of course this must be allowed or else its a moot point, but whatever the answer it will get the question off my mind. Thanks for your expert advise, Ken

Hi Ken,

 

Thank you for the clarification. Unfortunately, no, as I understand the SS law (I do SSD, which gets converted at full retirement age to SSR), only income from working (and of course SS taxes paid) will be utilized, not income from investments or other sources. I wish I had better news. Sorry.
