Question

We have a home that we have been trying to sale with the people living in it to buy it and so far they haven't been able to get their loan. So we put our home back on the market and advised them of this and told them they would have 1st chance to buy if there was a offer for our home. So the problem is, they won't keep it clean and won't let possible buyers look at all the rooms. We can't afford to remove them as they are at least making the house payment and I have lost my job and we life in another home. Can I tell them that they have to have it clean and if I bring in a crew that they will have to pay for it or is there some charges that I can file against them since they refuse to keep it half way clean and not stinky? Thanks for your help

I have had our realtor call them in advance to let them know when they are going to bring someone in and then she refuses, we have made an apt. for a showing giving her 1 wk notice and it was even worse for show.

is there a written lease agreement in place? if so, what does it state with respect to their obligation to keep the home in viewable condition?

No, we have an expired contract with them living there month to month and would be given 30 days notice if and when the home is sold.

ok, you would have to get them to enter into another contract whereby they agree to maintain the property in viewable condition, and expressly granting you the right to bring in cleaners to clean the property at their expense if they fail to properly maintain the property.
