Question

I received a garnishment on a back acct for an old credit card acct that had gone to collections. The law firm that performed the garnishment says they cannot do anything until after the 120 day period is up unless I can pay the 18,000 in back interest. I offered to work something out with them, but they refused until next February when I can "call them back". I couldn't pay the amount 5 years ago due to a job loss and I'm not much better now as I'm just getting things back in shape. Is there anything I can do other than wait until February 2010?

In order to attach your bank account they must have a judgment against you. If you were not personally served with the summons and complaint for the underlying lawsuit, then you would need to file a motion to have the judgment set aside and the garnishment terminated since they violated your right to due process of law.

The state bar association can provide you with attorney referrals as well as any low cost programs that are available in your area. I would not allow them to get away with this if that is what happened. It may be a zombie debt for which you are no longer liable anyway.

I looked back and did get a judgement against me over a year ago. I had tried to contact the law firm after that and left a message for them to return a call to me. Unfortunately, I had forgotten about it and now this. I know I'm at fault for not following up, but just want to make it right without waiting until next year if possible.

Since you were aware of the lawsuit, then you could not get the judgment set aside and there is no basis to terminate the garnishment, although you could file a motion to terminate at any time with the court. The creditor would likely agree to release the attachment if you pay the balance of the debt. Otherwise, they are acting within their rights since they have a legitimate judgment against you.
