On Nov 3, 2009 I was denied porchase of an antique firearm by the Cabela's store in Lacey.... They insisted that I have Concealed Pistol License under RCW 9.41.070. I explained to them as a retired WSP officer I was exempt from that requirement under RCW 9.41.060 and provided them with the proper documentation. They said that law enforcement commission cards and other law enforcement documents wore "worthless" and still denied the purchase. 1. Have they violated my constitutional rights ? 2. Is there am e-mail address where I can send you a copy of the complaint I filed with the President of Cabela's ?

Answer

You are referring to your right to bear arms, and whether by virtue of their failure to understand the law your rights were violated. While you do have a right to bear arms, that right does not extend to forcing a retailer to sell arms to you.

Is ignorance of the law a valid defense on there issues....
It would seem to me when you have minimum wage employees who "going by the law" they should know the law.

The law does not require them to sell you the firearm, the law makes you eligible to purchase the firearm without the License. It is a subtle difference but an important one.
