Question

I am a single mother of a 20 month old. I did sign an affidavit acknowledging paternity and her father is on her birth certificate. He has shown no interest in being a parent this entire time and has given me less than $300 in child support. He has a very lengthy record with traffic violations, midemeanors, and one dwi. I am wanting to go into the military and in order to do that I have to sign my rights away "temporarily." I am wanting to sign her over to my parents because I know I will get her back. Now the "father" is threatening to take her away from them because we have that affidavit signed and he is going to get a paternity test. Can he really do this?

Thank you for your question. Unfortunately, the legal presumption is that a child's best interests are met through a relationship with their biological parents. This means that if he wanted to file for custody and could show that it would be in the child's best interests a court may consider it. As long as he is not a danger to the child, a court may not be inclined to consider his criminal background. Your parents would then be in a position to prove that their custody of the child is in the child's best interests. The court would have discretion to make a ruling that is in the child's best interests. It is hard to know how a judge would rule, but conceivably he may be able to win custody with your parents merely having visitation. ________________________________________ Please let me know if you have any other questions on this matter or require clarification.
