Question

I was wondering if my son teacher can deny him a chair to sit during the whole day if he forgot to put his chair on the desk the previous day. According to the teacher that is the discipline for not putting the chair up. I just dont understand how my son can be disciplined like this with my notice or permission. Mr. Mendoza

Hello -

There are no federal laws that bar this type of discipline in the classroom. Teachers have been reprimanded for physical discipline (spanking) in recent years and have moved towards non-physical form of discipline such as making children stand. A child does not have a constitutional right to a seat in a classroom, so there are no civil rights issues here either.

Unfortunately, there is nothing inappropriate about this punishment. If your child has some sort of special health needs that are affected by standing all day, I'm sure a call to the teacher would help in deciding on some different but equally affective methods of discipline.
