Question

We live in Protivin, IA my sons just moved in a house he bought and the neighbor immediately told my son "I do not like Rottweilers , and I do not like Pit bulls" My son fenced his yard and has them in and out throught the dog door. The cop showed up and said there was a complaint about the dog barking (only one) and he was going to jump the fence (only one) the pitt bull has only three legs and doesn't bark anyway with no warnings my son is told he has to get rid of the dogs. Is there any legal measure he can take to keep his dog. He's willing to get a bark collar and put a 2nd 8foot wooden fence around the existing chain link fence?

We have tried to talk to one of the city councel members to find out our options but he has not returned our call. Another neighbor that lives right across from my son said the dogs do not bark all the time. And they walk past his house and the dogs do not bark at them. However the neighbor that is complaining told the cop that all the ladies are afraid to walk by. The cop went to the yard and said "that dog sure doesn't like to be stared down I would be afraid" Well what dog does like to be stared down.

Did the police officer give your son a written citation/ticket stating he must get rid of the dog? If not, then your son does not have to get rid of his dogs. There usually are noise ordinances which could explain the complaints about the barking. However, if the dogs are not barking, and your son has proof, then, he may file a complaint for harassment against the neighbor.
