Question

I had recieived an IRS Adjutment (or Audit) for my 2005 Tax Return and after review i paid the adjusted amount for the federal taxes. Now i have received an adjustment notice from Maryland asking me to pay the taxes since my 2005 Federal return was adjusted and i paid. I was wondering what should be my next steps. It has been 4 years - i thought the adjustments can only happen within 3 years of the tax year.

Hello rajas,

 

The IRS normally has 3 years from the due date of a return, to audit that return and make adjustments. In some cases the statute can be extended to 6 years if the income was under-reported by more than 25%. However, the individual states are not bound by these same statutes.

 

Each state has different rules as far as the time limitations they have to audit and/or adjust the amount due on a return. However, one rule that is universal among all states is that when an adjustment has been made by the IRS on your federal return, you must report those same changes to the state. If you do not report the changes on your own, the state can make the changes for you, based on the information supplied to them by the IRS. Because of that, you would still be liable for the additional taxes owed in the state of Maryland.

 

If you feel that the adjustments made by the state of Maryland reflect a higher tax than what you really should owe due to the IRS adjustments, you can still file an amended return with the state and calculate the actual amount of tax that you believe to be due. But once an adjustment is made by the IRS, those same changes must be submitted to the state, and they are not bound by any time limitations on changing your return for that year.

The problem with my Federal return was that i had claimed Itemized deduction mistakingly for things which i could not itemize whereas i should have claimed Standard deduction (which was done later as part of the adjusted). As a result i had to pay Taxes on the difference amount.

 

Now coming to MD. Can i now if i have some documents provide those to MD so that the owed amount comes down? OR do i have to pay the amount since i have already done so to Federal?

 

Also is it possible to pay the amount monthly to MD rather than a lump sum?

Hello again XXXXXXXX,

 

The income which you report to the state of Maryland is based on the same taxable income you reported to the IRS. So if your deductions were lowed on your federal return which resulted in higher taxable income to you, then that same higher income is reported on your MD state return, and that is what your state taxes will be based on.

 

I would still suggest that before paying this tax bill that you fill out another return on your own for the state of MD, based on the figures as they were adjusted by the IRS, just to be certain in your own mind that the state has correctly calculated the extra tax they say you owe. The state can make mistakes just as easily as anyone else, so you want to be certain they have not over estimated your actual tax liability here.

 

As far as setting up a payment plan with the state, this can be done, and you can actually fill out the application for a payment plan right on the Maryland state web site. last Q.. the Owed Amount includes Interest as well and the state notice doesnt tell me how it was calculated. Now when i do my own MD return how to i figure that..amount in?

 

and should i pick a 2005 version of the MD tax form or the latest would do?

Hello again XXXXXXXX,

 

It will be difficult for you to calculate the exact interest yourself, because the interest rates they use are based on varying rates which changed each quarter, so it would be a very complex calculation. If the notice they sent you did not break down how much of the bill was for the actual tax and how much was for interest, you may have to call the state to get that breakdown. Then when you fill out the form, just compare the actual tax figures to make sure they match.

 

As far as the tax form, you should use the 2005 tax form, because changes are generally made each year to those forms.
