Question

I was taken from my home and given a DUI by a a young Platteville Colorado cop who was out of his jurisdiction and the case was dismissed because it was found there was not only no probable cause and the the evidence was not admissable. The problem now is that my license was revoke prior to the hearing and I am told that even though the case was dismissed I I receive no ticket, I still can not get my license back, and I can not even appeal to DMV. Can this be true?

The attorney (Robert Ray of Greeley) told me this, and I have been trying to research on internet to see if there is a way to appeal but can not.

Yes ; Mr. Ray was retained and did win the case in Weld County Court (#09m1798), but is telling me that that, even though the case is dismissed, that does not affect my license revocation with the DMV.

I just want a second opinion to see if that is in fact true and there is nothing that can be done to have this false charge erased from my record and driving record, so I can get my license back. I know Mr. Ray is very busy and did a great job, but the DMV taking a license when the case is dismissed seems impossible.

Hi, sorry to ask another question, but what does your driver's abstract say as to why your license is suspended? There are such things as an administrative suspension, which is actually what you may have suffered, which is normal in some instances, upon arrest alone. However, I agree that it would appear that is should be reinstated. What happened when you made the appointment with DMV to get it reinstated?
