I need to know if i have a case. My ex-husband has signed papers which he had someone forge my signature which allowed him to be free from any financial responsibilities that we were involved in. All I wanted for him to do was take care of his on bills. Jane

It is possible to contest the validity of such a document. Your attorney may find that you need to hire a handwriting expert to evaluate the signature so that you can show that you did not sign the document.

Further, depending on the circumstances, even if the signature was real, such a document might be unenforceable due to lack of consideration or unconscionability.

It is illegal to fraudulently sign another person's name. You may wish to inquire with your attorney as to whether or not you should file a criminal complaint. However, it's worth noting that a criminal conviction could affect you indirectly (for instance, it might be impossible for him to pay alimony if he becomes incarcerated).

However, to answer your question: yes, a fraudulent document can be challenged in court. You will want to retain an attorney to assist you in this matter.
