Question

my 18yo dd is the mother of a 7mo old son, whom she has relinquished to the care of the paternal grandmother (father is 15-16yo-in juvie). my dd neglects to apply for WIC or to sign power of atty form enabling either of us to seek medical treatment for the child..we are both of us single moms who cannot afford to hire an atty to obtain POA or guardianship. the paternal gm has had the child f/t but i rarely get to see him. what do we need to do to arrange a temporary shared guardianship, visitation-- or something--that allows me to share responsibility for the childs care and nurture in his mothers absence? we live in texas

sorry....dd = "dear daughter". i am the mother of the 18yo daughter. no she did not relinquish her rights formallay. for the first few months after giving birth she and the baby lived with the paternal grandmother. gradually my daughter, amber, took to hanging out with her friends, then returning every 2-3 days, until finally just moved out and left the baby with sherrie. so amber has basically abdicated responsibility for the baby to the paternal grandmother out of sheer neglect. sherrie is in a better position to help with the baby since she has flexibility to bring him to work with her, where i do not....and my work hours run much later. amber visits with the baby infrequently. on several occassions she has agreed to accompany us to sign POA forms, or to apply for WIC, etc., but repeatedly fails to show up. the baby is behind on his shots. now that im sure my daughter will not be assuming her parental duties anytime soon, i want to help - and share rights as a conservator, or similar...to avoid any potential conflicts between the grandparents. i want to get something set up asap before the father of the child has a chance to make things difficult when he is released from juvie in january. i hope this helps.

Thank you for the clarification. Yes, it helps.

 

You and the other grandmother need to file petition for Guardianship of the Minor, so that both of you will have legal rights to the child and make decisions concerning the child. A Power of Attorney will not be appropriate here. The guardianship forms are available in the Courthouse at the Clerk's office. If you need help completing the forms, the court personnel may be able to assist you. However, once you get the forms, they are self-explanatory.

thank you. sorry for the delay; a crisis broke out soon after that and wasnt available to reply. the payment has already been posted, but i just have one more question - about how long of a turnaround time can i expect for some response after i submit the paperwork, and does it require a court appearance?
