Question

Hello, My daughter's car was hit by another car. Before the police came the driver went back into McDonanlds, where she had pulled out from. When the police came they got her name, address, and insurance from her car. She never came out and spoke to the police. When we got the police report we called the insurance and were told it had been canceled in March. First my daughter called the girl at her house and she wouldn't talk to her, then I called later to try and see if she had insurance now. She wouldn't speak to me either. I called a second time and her mom or dad(I not sure which) hung up on me. My daughter got a call from the police saying we were being charged with harassment. Do I need to get a lawyer and is this going to be a big problem. Can she charge me with this when I'm trying to find out about her insurance?

Nothing, the police just called my daughter to tell her about the harassment charge by the driver of the other car.

She can certainly file a complaint and you will need to defend the charge. It could be a problem and a restraining order could issue. It doeesn't sound like harrasment actually occurred.

 

Rather than continuing ask about insurance, yopu can file a lawsuit against her for the damage. You will then legally be able to get any insureance information through discovery. A court will then harass her for failure to produce the documentation if she has it. Your insurance company may handle this if you ask them to. In the end you will never get satisfaction from this woman without going to court. You should inform the officers that the woman had expired insurance. Driving without insurance is a violation in Texas.
