Optional Information

Already Tried:
I have stored a motorhome for almost 2 years with a verbal contract to be paid a monthly fee, and I have done many repairs where the owner bought the parts and I made the repairs. Now he wants to remove the motorhome from my property without paying me. Can I file a mechanics lien, possessory lien, or chattel lien, and keep the vehicle until I am paid? I live in the State of Washington.

Accepted Answer

Yes, you may assert and file a mechanic's lien on the property. In addition, you can also prohibit the customer from entering your property, as if he does so without your consent, you would be able to file a claim of trespass against him as well.

But his attorney has told us that we do not have the right to do a mechanic's lien because we are not licensed. I called the WA State Dept. of Licensing and was told that as long as I don't make over $12000.00 in one year I don't have to be licensed. So, you are sure that in the State of WA a mechanic's lien is legal for me to file, and legal for me to keep the vehicle until paid?

Typically, you do not need a license. However, if you earn more than $12,000 per year doing this type of work, you will need to apply for a license.
