Question

I presently have a lawyer that I am not happy with. I hired him because my son fell at an underage drinking party and died. We have been goin back and forth for four years now and now he wants me to settle for an amount that I feel is a slap in the face. Can I fire him and hire a new lawyer? Please, I need some advice.

You can fire him and retain a new attorney. However he will still be entitled to a portion of any settlement. Therefore you are likley to have a problem finding a new attorney to take the case. I understand your frustration and I am very sorry for your loss. Unfortunately in our legal system all the punishment that you can extract is money, a very unsatisfactory compensation for the loss of a son.

I do not know the facts of the situation or how much you are being offered in a settlement. When you are evaluating a settlement the first place to start is how much money is available for a settlement. Usually that is the policy limits of the available insurance. Then you look at the negligence and the percentages to be apportioned to the parties. Then you look at jury awards in your area. I am sure that there is an experienced mediator in your area. Have your attorney set up a meeting and have the mediator give you an opinion on the likley result of a jury trial.

I understand that he is still entitled to his share, and I have no problem with that. I can tell you that there are two policies, one is worth $500,000.00 and the other is $350,000.00. He wants me to settle for $30,000.00 and after everything is paid I will end up with a little over $12,000.00... This is why I feel like it is a slap in the face. The other thing is that the mother stated in the police report that she was home. Where is the justice? I am just torn, I know no amount of money will bring my son back, but I am willing to settle and have each company pay $50,000. each but my lawyer says I can't ask for that. Is this true?

You can always go to a jury trial. If you insist on that here your current attorney is likley to opt out and you will have to find a new attorney anyway. If the mother was home they are liable and I agree with your decision not to settle for that offer. Ask your attorney to set up a mediation.

Thats what I don't understand. It is set to go to trial in January but he says I will end up with nothing. If I want to go to trial then I now have to come up with $1000.00 up front to proceed.

He should be able to set up a mediation before trial. Ask him to explain why you will not get anything.

He says it will be hard to prove she was home. She gave the police three reports and all three were different, but the first one she stated she was home in her bedroom. So why would this be hard to prove?
