I had an accident on 10 23 09 and the insurancs company recived an estment for the repairs at 4200.00 the man backed up to my truck pushed the two right doors in and part of the rear quarter pannl and the oficer did a report and said you aer in a shopping cintre but the man back in to you so he is atfault. the insurance company totaled my truck. the truck is9years old and has 240000plus miles. they are going to make me an offer 11 5 09 . I told them that i am going to keep the truck because thats all i have for my ac and haeting work and thay said ok. my question is the other person is at fault but iam the one that is losing in the lone run do i have any legal recors lupe in texas . thank you.

Yes, your recourse would be to file suit against the person's insurance company for the damages in excess of the blue book value. But bear in mind that the insurance company is only obligated to pay the blue book value plus a sum to compensate you for the loss of use of the vehicle.
