Question

I have a credit card debt that has been forwarded to debt collections. I agreed to pay 40.00 a month, which was one of the choices. I started paying it and am receiving collection calls at work. They say it has to be direct withdrawl from checking account to stop calls. I am not comfortable letting people have access to my account because direct digital has taken out 300.00 when they wasnt suppose to do. How can I stop the calls at work when I am making payments?

Accepted Answer

Hello,

Thank you for your question.

You appear to have an action against the debt collector under the FDCA based upon their contacting you at work after you demanded that they not contact you there.

It is a violation of the Federal Fair Debt Collection Act (FDCA) for a debt collector to use unfair tactics such as harassment, false statements, notify third parties or threaten acts they cannot legally undertake.

You may file suit in Federal Court for each violation of the Act.

I have attached the link to the FDCA for your review.

I hope that the information which I provided was helpful to you.

Best wishes for a successful outcome. If you have additional questions, please do not hesitate to submit them to me directly.
