is it illegal for a construction contractor to give a kickback to a property manager of a managed condo community. Also can I inform owners of this knowledge even though i can't get proof without a court involved. i know because i used to work for this company as a manager.

Accepted Answer

Yes, that would be illegal and a breach of the fiduciary duties owed t the condo community.

You certainly will take a risk by informing them or making any statement concerning such if you ultimately can't prove it - you risk a per se defamation action against you.

Answer

You could or should contact the board of directors for the HOA - it's actually their action because that's from whom he's stealing from.

would getting a lawyer to advise me on how to go about that be worth it now or afterward

Accepted Answer

No, you don't need an attorney - unless to prove what's going on you have to self-incrimination - then you do. Then I would certainly advise to get an attorney BEFORE you do anything.
