Question

I cosigned a loan for my ex-wife but its not in the divorce. She is 66 days past due and the lender is about to reposess the vehicle. She has asked me to catch the payment up and I will never hear anything out of her. I know this will not clear me of my obligation to the finace company but is there anyway that I can have her sign something that states if she goes 10 days late that I can take posession of the car. My name is on the title as well but she is primary.

Thank you for your question.

Your ex wife can sign an agreement whereby she agrees to transfer the car to your name in the event she is late on the payments.In the event you need to enforce the agreement, you will need to file a court action to transfer the title.
