Question

During a child custody mediation yesterday, my childs mother made statements to the mediator that I use meth. She also went on to say that i sell stolen parts out of my business. Due to her statements ( that she knows are entirely false) i am now required to drug test. I have no problem with this except that now my time and money for the test are to come out of my pocket. Can i sue her for defamation to recover the money i have to now spend and to secure a reversale of her statements. She attacked my livelyhood, i have owned my business for 12 years and my reputation with my clientel may suffer due to her false statements.

This just happened. Im worried what this is going to cause to my near future. I now have primary custody of my 10 year old. She is tring to gain full custody. two years ago we went through this same procees and back then i established that she was a drug addict so now she is tring to turn the tables. I really just want her to recant her statements and pay for these unwarrented drug test costs.

Yes, that is possible, you would have a case given that she made false statements of fact to a third party who believed her to your detriment. Unless she made these statements to your clients, your case will be based on what was said in mediation.
