Question

I am having a dispute with my neighbor regarding propery lines. While I was away from my home this summer he entered my property and took a lockking device off o my gate and instslled his own lock and chain on the gate. I have had the property surveyed and his fence in anywhere from 7" to 12" over the centerline of the abanded alley that ran between our property. What can I legally do to get him to move his fence and take his lock and chain off of my gate?

Are you saying his fence is on your property? Does the gate relate to both your properties?

His fence is on my property. The gate relates only to my property.

You can remove the lock immediately. As for the fence, I would send him a formal notice to move the fence otherwise you will file an action for ejection (this is to have the fence removed as tresspassing). If he does not move the fence, file an action to have the fence removed as encroaching on your property. If this answer is responsive to your question, please accept it.
