Question

My Mother passed away last year. I inherited her house which is free and clear of any mortgage or incumberances. What do I do to get the house in my name and possibly my wife's?

Hi gw, if you haven't done so already, you have to open probate of that will at the county court where she lived. Because she listed you as executor, you have first dibs to have that roll, and the probate court will give you that authorization after you fill out some of their forms. Once you have that, and once you handle/pay all debts of the estate, provide notice to creditors, etc., and gather all assets, you can determine if that house needs to be sold to pay debts (with balance to you) or if it can be dispersed as a whole, to the beneficiaries (you). If that is the case, you can use a title company in all likelihood who can prepare the proper title work to put it in your name and get it properly recorded with the county. First step, however, is to get down to that probate court. If you need assistance with being the executor, consider reading Mary Randolph's, "The Executor's Guide" which I understand can be found on Amazon. I'm very sorry about the loss of your mother. Please also keep in mind that IF you have no inclination to handle this yourself, you can hire a lawyer to do it for you.
