If the trustee commits fraud, he can be held personally liable, in addition to criminally liable. You can, however, speak to him about your concerns, and better yet, put them in writing and mail them certified r.r.r. The beneficiaries have no personal liability for his actions. And, if his actions end up costing the estate, you can certainly have a claim against the trustee for the damages. Keep in mind, that the bank will only agree to the short sale if he establishes their particular criteria, so their own rules may very well protect him from himself.
