Question

Please answer in two to four sentences. 1.Describe the responsibilities placed on a paralegal when he or she finds out about and illegal act-such as fraud, deceit, dishonesty, or misrepresentation-and the information isn't confidential. 2.Explain why some states forbid ex parte contract by attorneys with jurors after a trial. Does this prohibit the attorneys from speaking to the jurors with the judge's permission? Also explain why an attorney might want to talk to jurors after a trial. 3.Three different sets of ethical guidelines for lawyers have been adopted by the American Bar Association. Identify these guidelines and explain how a paralegal can determine which of these rules apply in his or her state.

Accepted Answer

1. The paralegal has the responsibility to report the matter to the attorney under whom he or she is working. That attorney then has the responsibility to take the appropriate action. 2. The state has an interest in seeing to it that an adequate supply of jurors is available. This purpose is frustrated if the jurors are going to be harassed by lawyers looking for reversible error in the jury conduct. If state law prohibits ex parte contact a judge cannot overrule that law. 3. NALA, ABA and individual state guidelines can be adopted by each state. The paralegal has to research the law and see which standard has been adopted in their state.
