Question

my mother passed away one month ago. her house is my fathers, He let her live there free until she passed. she only has her personal items inside the house. one of the four sisters wants to try to take everything out and store in somewhere, i want it left alone, my dad says theres no rush, can i get anything legal so that my sister cant come and take her things. she had no living will and no executive of estate, NO legal doc. at all. I have proof that we paid all of her bills for the past 2 years and took care of her. if that really matters. Please help. cant really afford attourney after barial

Answer

Since the house belong to dad, he has the right to exclude anyone from coming onto his property to remove your mother's things. Otherwise, since there was no will, you can petition the court to be appointed the administrator of your mother's estate. The court will give you an order, called "letters of administration" which will give you legal authority to handle your mother's property.

To be appointed you would need to file the application for appointment of administration [form AOC-E-432]
