Question

my son stold a U-Haul truck and traveled across state lines. If the owners (U-Haul) drops charges will that help? Also is it legal to be speaking with U-Haul about this trying to see if we can make a deal?

Did your son not disclose that he was moving across state lines? It would be helpful to know a little more about the situation. As many times UHaul will permit trucks to travel across state lines during the commission of a move, knowing the situation in context would be helpful.

No he straight out stoled it but there is a possibility that U-Haul will drop it

Thank you for providing that clarification.

 

If you can work with UHaul to persuade them not to press charges, then that is a very good thing. However, keep in mind that if the matter has been reported to the police, UHaul may not be able to drop the charges. Once the crime has been reported and investigated, it gets moved up to the prosecuting attorney's office who then decides on whether to prosecute. Although the prosecuting attorney will usually talk to the victim and take their thoughts into consideration, if the prosecuting attorney does not want the charges dropped then prosecution will proceed. Your best bet is to try to get this resolved with UHaul without getting the police involved.

One more Q. First it's good to know that I am not breaking the law by trying to talk with U-Haul. Final Q will the DA have less of a case if U-Haul has dropped charges and possibly want to plea down?

U-Haul cannot drop the charges. Even if they decide they do not want to pursue it, the DA can compel them to testify and present their evidence. This is why the current stage of the case is important. The DA is likely to place the most importance on the strength of the evidence. U-Haul's desire to drop charges will be secondary. The DA will look at whether your son has been in trouble before and his previous history of this type of behavior. If he has not been in trouble before, the damage was merely property damage, the DA has not put a ton of time into the case and U-Haul is not excited about moving forward, then there is a good chance that they will consider pleading this out.
