Hello,

My name is Eli and I am one of JustAnswer's attorneys. I'll be helping you resolve your matter today.

There is not standard duration which is considered "long," but generally anything over 7 years, or even 4/5, if children are involved.Arizona does not consider marital misconduct when awarding alimony, but will consider all relevant factors, including the following guidelines:
1. The standard of living established during the marriage.
2. The duration of the marriage.
3. The age, employment history, earning ability and physical and emotional condition of the spouse seeking alimony.
4. The ability of the spouse from whom alimony is sought to meet his or her needs while meeting those of the spouse seeking alimony.
5. The comparative financial resources of the spouses, including their comparative earning abilities in the labor market.
6. The contribution of the spouse seeking alimony to the earning ability of the other spouse.

Best of luck in your matter. I'm here if you need any more clarification or follow up info.

I hope you found my answer helpful, and if so please click on the GREEN ACCEPT button for my answer. This is the only way for me to get credit for my work.

Your question will not close, and you will still have the opportunity to follow-up if and I would be happy to answer any and all of the follow up questions.

Remember, sometimes the law under which your situation falls does not give you the outcome or the choices you wanted - please understand that this is not the attorney's fault, but the way of circumstance.

There might be a delay between your follow up questions and my answers because I may be helping other clients or taking a break.

The extent to which the spouse seeking alimony has reduced his or her income or career opportunities for the benefit of the other spouse. 8. The ability of both parties after the divorce to contribute to the future educational costs of their mutual children. 9. The financial resources of the party seeking alimony, including marital property apportioned to such party, and such party's ability to meet his or her needs independently. 10. The time necessary to acquire sufficient education or training to enable the party seeking alimony to find appropriate employment and whether such education or training is readily available. 11. Excessive or abnormal expenditures, destruction, concealment or fraudulent disposition of community, joint tenancy and other property held in common.

Is the spouse entitled to half my retirement if we were only married for 4 years of this current job? We were married for 11yrs, but only 4 durring my current employer and she want half my retirement whenever I do retire. Is this possible? I work for the local sheriff's office.

Answer

The rule of thumb is if you will be paying taxes on what you get for retirement, then she will be eligible for 1/2 of it. If not, then she's not.

I am sorry, i do not understand. She will get half of it? so if I work for a total of 25 yrs with this employer and retire, she can get half my retirement even if we were only married for 4 years worth of my work history?
