Question

I filed papers for an uncontested divorce in Maryland. My wife hired a lawyer to respond. Is in disagreement with the 12 month separation. I receive the answer last Saturday,October 31, it had her first name wrong and no case number. I spoke to the civil court clerk today and they had yet to receive the answer. My question is, I do have a reliable witness that will testify as to the one year. Wife did work in the area but I would stay elsewhere when she came here. I live 2 hours from her residence in Baltimore. She moved back to there to be closer to her main job and for establishing her residence in order to refinance it as a principal residence. It was a rental. I wanted to make it easy on her by being uncontested. Our marriage became unbearable. She threatened me with divorce many times over the last three years, made me leave the house and threatened me with physical violence as well as mental abuse. My question is can she cause a delay in our divorce by this move on her part. Dan

Yes, there are many ways she can delay the divorce and this is one of them. If she starts contesting the one-year separation, then it will become a contested divorce and everything will need to go before a judge who will hear the issues and rule and possibly require evidentiary hearings.

You should continue trying to reason with her and show her that a contested divorce will cost you both a lot more money and leave less money for the both of you. The more you both can agree to, the cheaper the divorce will be and the more you will both have in the end.
