Question

My wife recently filed for divorce and she is a pastor on staff at our church we have attended for 30 years. They sent a letter out to the members saying i had been unfaithful for at least 15 years and she had biblical grounds for divorce. No one came to me before the letter went out to ask me about it. I also asked to meet with the pastor before the letter went out and when i went there for the meeting it was an ambush with two board members my wife and my two grown sons ..and it was a bashing me..excommunicating me and having my boys escort me out ot the church to my truck..it was very tramatic and we are the talk of the town of about 50,000. I am a professional in the community and it has been very hard..do OI have grounds for a slander suit or lible against the church and or the Pastor? Larry

yes i have been unfaithful and we have worked through a couple of them this last one was mostly circumstyancial and could not be proven that sex had taken place.....but the allegation that i had been unfaithful more than once would be true

Accepted Answer

Thank you very much for the additional information. Because the facts are true, you are barred from suing for defamation, as suing for defamation or libel requires that the person state comments that are defamatory (untrue). Since you did commit the acts, it will be hard to file for defamation, but what you can do is file for invasion of privacy, and allege that a public disclosure of private facts created injury, humiliation, and damages to your reputation. If she cannot prove her allegations against you for defamation, you are free to try it, but I would advise against it.

Sincerely,

XXXXXXX XXXXXXXXX XXXXXX, Esq.
