Question

My son's biological father introduced my son to marijuana when he was 11 years old. We were divorced. We had a joint settlement divorce in which he did not pay regular child support, or share expences of raising my son. Back to the main question, my son continued his drug use and abuse and has become a heroine addict and been in trouble with the law himself. He is now 25 years of age. I have pictures of my son holding 3 quart size zip lock bags of marijuana in his hands as a 12 year old. The pictures were taken at his fathers home. The marijuana was cultivated at his fathers home and I have pictures of that to. I have spent thousands of dollars trying to get my son the support he needed to make better choices while all along his father smoked marijuana with him. My son is now an addict. Is there any financial retribution I can seek to hold his father accountable for his parental negligence?

It is too late. Any parental negligence claim has long since expired since your son is 25 now. Even if there could be a suit brought, it would have to be brought by your son and not you since you couldn't sue for his damages.

I just don't see any legitimate way you can bring suit and win in this situation. If you could, then many people would sue the other parent for being a bad parent. The state may be able to do something about current drug use, but they can't do anything for the past negligence and drug use.
